The GRAPHIMATOR™ TERMS AND CONDITIONS
The GRAPHIMATOR™ (trademark of Ohio Carbon Blank Inc.) is software for estimating and purchasing custom graphite products and is "free of charge" to registered users only. Authorized use of the GRAPHIMATOR™ is by electronic signature (I agree . . . and email address) shown below, and constitutes registration and acceptance of this Agreement. Ohio Carbon Blank Inc. reserves the right to modify this Agreement and/or the GRAPHIMATOR™ at any time and becomes effective when published on the Ohio Carbon Blank Inc. website. Continued use of the GRAPHIMATOR™ following such modification is your acceptance of such changes.
TERMS & CONDITIONS:
You agree not to copy, modify or transmit in any way the software or cause harm to Ohio Carbon Blank Inc. This includes: assisting others in violating or breaking existing patents, local, state or federal laws, and applicable rules and regulations. Security, privacy and confidentiality of the GRAPHIMATOR™ have been proactively addressed through the use of Verisign® e-commerce encryption coding. However, use of the GRAPHIMATOR™ is at your own risk. GENERAL:
Any claim relating to this Agreement or the use of GRAPHIMATOR™ shall by governed solely and exclusively by the laws of the State of Ohio and/or United States of America. Any action to enforce this Agreement shall be brought solely and exclusively with the Federal and State courts having jurisdiction in Lake County, Ohio. This Agreement constitutes the entire agreement of the parties with respect to the subject matter hereof. Failure or delay on the part of the Ohio Carbon Blank Inc. in exercising any right or remedy hereunder or enforcing the terms and conditions of this Agreement will not operate as a waiver thereof. If any part or provision of this Agreement is found to be invalid, unenforceable or void, then the remaining portion shall remain in full force and effect. Unauthorized use of GRAPHIMATOR™ (without permission) is strictly prohibited and subject to prosecution.
